The Fine Print

The legalese required by our litigious society follows. Basically it says (1) you should respect our rights with respect to the documentation and software and (2) that we are not liable for anything, including coffee spilled in your lap while laughing at insidious error messages.

Please read the following terms and conditions carefully. By using this documentation or accessing the CGS WEB site, you agree to these terms and conditions; if not, you should return or destroy all copies of this material and/or refrain from using the WEB site.

Restrictions on use

Material from these HTML pages, the Computer Graphic Service, Ltd. (CGS) home site, and any other materials owned or controlled by Computer Graphic Service may not be copied, republished, uploaded or distributed without the written consent of CGS except as enumerated below. Any other use or modification of these materials violates CGS's intellectual property rights.

All software, files, and images contained in this package (together, the "Software") are only licensed to you by CGS; title and all other rights are retained by CGS.

Restriction of Liability

Computer Graphic Service, Ltd. will not be liable for any damages or injury caused by, including but not limited to, any failure of performance, misprints, errors, omission, computer virus, or other failure. CGS will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this Software, even if there is negligence on CGS's part or CGS has been advised of the possibility of such damages, or both. The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages. CGS's total liability to you for all losses, damages, and causes of action (in contract, tort (including without limitation, negligence), or otherwise) will not be greater than the amount you paid to access this material.

Submissions

All remarks, suggestions, ideas, graphics, or other information communicated to CGS through this site (together, the "Submission") will forever be the property of CGS. CGS will not be required to treat any Submission as confidential, and will not be liable for any ideas for its business (including without limitation, product, or advertising ideas) and will not incur any liability as a result of any similarities that may appear in future CGS software. Without limitation, CGS will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere. CGS will be entitled to use the Submission for any commercial or other purpose whatsoever, without compensation to you or any other person sending the Submission. You acknowledge that you are responsible for whatever material you submit, and you, not CGS have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright.

Limitation on export

Except as described otherwise, all materials in this site are made available to licensees of the Genplot or RUMP software for informational purposes only. Some software from this site maybe subject to export controls imposed by the United States and may not be downloaded or otherwise exported or re-exported: (a) into (or to a national or resident of) any country to which the U.S. has placed an embargo, including without limitation, Cuba, Iran, Iraq, Libya, North Korea, Syria, or Yugoslavia; (b) to everyone on the U.S. Treasury Department's Specially Designated Nationals list, or (c) the U.S. Commerce Department's Table of Denial Orders. If you download or use the Software, you represent and warrant that you are not located in, or under the control of, or a national of any such country or on any such list.

Termination

CGS or you may terminate this agreement at any time. You may terminate this agreement by destroying all materials obtained from CGS and all related documentation, backups, and installations. CGS may terminate this agreement immediately if, in its sole judgement, you breach any term or condition of this agreement.

Miscellaneous

These Terms and Conditions will be governed and be interpreted pursuant to the laws of the State of New York, United States of America, notwithstanding any principles of conflicts of law. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions. This document is the entire agreement between you and CGS, and can be revised at will by an update of this document.

Trademark Information

The following trademarks used herein are owned by CGS: RUMP, Genplot. All other trademarks are the property of the respective trademark owners.
